Privacy Statement Huisman Groep BV 05-07-2018

Huisman Etech Groep BV collects and uses information about its employees in order to properly perform its services. Huisman Etech Groep BV is, furthermore, committed to protecting and respecting your privacy. This Privacy Statement describes the privacy rights with regard to the data we process about you, as an employee, as well as the steps we take to protect your privacy. Carefully read this Statement.

Huisman Etech Groep BV and all companies that form part of it are companies that engineer, install and maintain (electrical) installations in various sectors. Huisman Etech Groep BV, Koningstraat 101, 6651 KK Druten, Chamber of Commerce number 30250646 is responsible for the processing of personal data.

Huisman Etech Groep uses various IT systems to carry out its business activities. These include AGP Projects, Intranet and a time registration system.

Which personal data does the Huisman Etech Groep collect and use?

Personal data that Huisman Etech Groep usually collects include:

HR/payroll administration:

  • Name and address, telephone number (private), date and place of birth, nationality, marital status, gender and e-mail address;
  • CSN number;
  • Bank account number;
  • Name of partner, name and date of birth of child(ren);
  • Copy of identity document;
  • Documents that demonstrate that you are allowed to work at the locations where you work, such as visas, work permits, etc.;
  • Certificate of Good Conduct and, if applicable, Certificate of Reliability;
  • Education, courses and copy of diplomas and certificates;
  • Employment conditions, fringe benefits and other individual agreements;
  • Performance interviews and interview reports;
  • Data on incapacity for work (data, reports from, among others, the company doctor and documents required within the context of the Eligibility for Permanent Invalidity Benefit (Restrictions) Act);
  • Attendance and absence records and specification of hours worked.

Intranet:

  • Name and address, telephone number (private and business), date and place of birth, e-mail address (private and business), gender;
  • Contract hours, reduced working hours, Time off for time worked, Works Council membership;
  • Education, courses and copy of diplomas and certificates;
  • Photograph;
  • Name and telephone number for emergencies;
  • Birth dates of any children;
  • Size of work clothes and shoes;
  • Travel administration.

Why do we use your personal data?

Huisman Etech Groep collects and processes personal data for the following reasons:

  1. in order to be able to carry out our Huisman Etech Groep activities;
  2. to comply with legal obligations where necessary;
  3. to comply with our obligations as an employer towards you;
  4. to provide data to third parties (see next page);
  5. upon commencement of your work at Huisman Etech Groep:
    1. to comply with your employment contract as well as any other agreements and rules that our employment contract or other contractual relationship with you must meet;
    2. to perform other HR activities (such as management of training courses and disciplinary procedures);
    3. to monitor observance of and compliance with internal policies and procedures;
    4. to comply with obligations and/or cooperate with investigations by the police, the government or regulators.

Are you required to provide us with the personal data we request?

Providing your personal data is a requirement to enter into an employment contract with you and/or to continue the employment contract. This means that you are obliged to provide us with your personal data. Failure to comply with this requirement may result in us not being able to continue the employment contract with you.

How long are personal data stored?

Huisman Etech Groep may (and in some cases, is legally obliged to do so depending on the type of data) store your data for a number of years after your employment with us has ended. In general, we store data on taxes and employment contracts as well as financial data for 7 years. Other personal data are stored for 2 years. We do not store these sensitive personal data any longer than reasonably necessary.

Do we transfer your personal data to third parties?

We will disclose your details to third parties if this is necessary for the performance of the employment contract or to comply with a legal obligation.

We share your data with:

  • Van Deelen (payroll administration office) for the payment of your salary;
  • NV Schade for your occupational disability insurance registration;
  • BPMT for your pension fund registration;
  • the occupational health and safety service for assistance during incapacity for work.

These parties are bound by contractual and other legal obligations to treat your data confidentially and to respect your privacy. They only receive the data they need for the performance of their work.

We also share your data with the government, the police, supervisors or law enforcement authorities if we, on a discretionary basis, believe that we are legally required or entitled to do so or if it should be necessary to do so as a matter of prudence.

What are your rights?  

  • The right of access to your personal data
  • You have the right to request confirmation that we process your personal data. If this is the case, you have the right to access your personal data and you are entitled to certain information about how these data are processed.
  • The right to correct your personal data
  • If you can demonstrate that the personal data we have about you are not correct, you can ask us to update these data or to correct them in another way.
  • The right to be forgotten / right to erasure of data
  • If we do not need to store or process data for any other reason, you can ask us to stop processing your data (or limit it) or to erase all or part of your personal data.
  • The right to object
  • Insofar as the processing of your data is based on the legitimate interests of Huisman Etech Groep (and not on other processing grounds) you have the right to object to the processing of your data by Huisman Etech Groep based on your personal situation.

Finally, you also have the right to file a complaint with the data protection authority in the country where you live or work or where you think a problem has arisen regarding your data. In the Netherlands, this is the Dutch Data Protection Authority.

Do we use monitoring systems at work?

To the extent that this is permitted by law, Huisman Etech Groep BV reserves the right to control, monitor and record access to, use of and the content of any data that are in the possession of or are processed by the IT systems of Huisman Etech Groep BV. We do this to investigate incidents and complaints and to act accordingly.

What about data protection when using Huisman Etech Groep BV systems?

You are responsible for the safe handling of your login details for the Huisman Etech Groep BV systems, in particular, the password that we have assigned to you or that you have chosen yourself. These login details are for personal use only. You are not allowed to share login details or other account information with others or third parties. The Huisman Etech Groep uses legally recognised security techniques for its systems.
